General terms and conditions of sale

1. Seller and contact details

The website www.galleriamariana.com is operated by Nuova Galleria Mariana S.r.l., with registered office at Via di Porta Angelica 65/67, 00193 Rome (RM), Italy, VAT number 07024511003 (the “Seller”). Contact details: info@galleriamariana.com, telephone +39 06 6861849.

2. Scope

These terms govern distance sales of the products offered on the website. “Consumer” means a natural person purchasing for purposes outside their business, commercial, craft or professional activity. Consumers benefit from the mandatory protections provided by Italian Legislative Decree 206/2005 (Consumer Code) and European Union law.

3. Product information

Essential characteristics, materials, dimensions, price and any warnings are stated on the product page. Images are illustrative; non-material variations, particularly in handmade products, do not constitute a defect if they do not affect the agreed characteristics. Before purchasing, the customer must check the description, quantity, variants and compatibility of the product.

4. Prices and charges

Prices are in euros and, for sales to Consumers in the European Union, include applicable VAT. Shipping charges and any additional costs are shown before the order is submitted. The Seller may correct clerical errors before the contract is concluded. If there is an obvious and recognisable pricing error, the customer will be contacted and may confirm the order at the correct price or cancel it for a full refund.

5. Order and conclusion of the contract

The customer selects the products, enters the requested information, chooses shipping and payment, and checks the summary before pressing the button that entails an obligation to pay. The order constitutes an offer to purchase. The contract is concluded when the customer receives the Seller’s order confirmation, unless the message clearly states that it is only a technical receipt. The confirmation summarises the products, price, charges, delivery address and main applicable terms. The Seller may refuse the order because of unavailability, incomplete details, suspected fraud or other legitimate reasons; any sums collected will then be refunded without undue delay.

6. Payment

Available payment methods are those shown at checkout and may vary according to the country or amount. Electronic payments are handled by authorised providers; the Seller does not receive the full card number. If payment is not authorised or is unsuccessful, the order cannot be fulfilled.

7. Availability

Availability shown on the website is updated with reasonable care but may change because of simultaneous orders or inventory errors. If a product becomes unavailable after the order, the customer will be informed and may choose, where possible, an alternative product or a refund for the unavailable item.

8. Delivery and transfer of risk

Destinations, costs and estimated times are shown at checkout. Unless otherwise agreed, delivery to the Consumer takes place without undue delay and in any event within 30 days after the contract is concluded. Stated times are estimates and do not reduce statutory rights in the event of delay.

For Consumers, the risk of loss or damage passes only when the Consumer, or a third party designated by them other than the carrier, takes physical possession of the goods. If the Consumer independently chooses a carrier not offered by the Seller, risk passes when the goods are handed to that carrier.

9. Right of withdrawal

The Consumer may withdraw without giving a reason within 14 days from the day on which the Consumer, or a designated third party other than the carrier, takes physical possession of the goods. For several goods delivered separately under one order, the period begins when the last item is delivered.

To exercise the right of withdrawal, it is sufficient to send an unequivocal statement before the deadline to info@galleriamariana.com or by post to Nuova Galleria Mariana S.r.l., Via di Porta Angelica 65/67, 00193 Rome (RM), Italy. The Consumer may use the form in section 11, but is not required to do so.

The goods must be returned within 14 days after communicating the withdrawal. Unless the Seller has offered collection or a prepaid label, the direct return costs are borne by the Consumer. The Consumer is liable only for any diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Original packaging may facilitate the return, but its absence does not automatically remove the right of withdrawal.

The Seller refunds all payments received, including standard delivery costs, within 14 days after being informed of the withdrawal, using the same payment method unless otherwise agreed. The refund may be withheld until the goods are received or evidence of their dispatch is provided, whichever occurs first.

10. Exceptions to the right of withdrawal

The right is excluded only in cases provided by law, including: goods made to measure or clearly personalised; goods liable to deteriorate or expire rapidly; sealed goods unsuitable for return for hygiene or health-protection reasons once opened after delivery; and sealed recordings or software opened after delivery. A discounted or promotional item is not excluded from the statutory right of withdrawal for that reason alone.

12. Statutory guarantee of conformity

Products sold to Consumers are covered by the statutory guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code. The Seller is liable for any lack of conformity existing upon delivery that becomes apparent within two years. Subject to statutory conditions, the Consumer is entitled to have conformity restored through repair or replacement free of charge or, where provided, to a proportionate price reduction or termination of the contract. 13. Alcoholic products

Alcoholic products may be purchased only by persons aged 18 or over. The Seller may request proof of age and refuse the sale or delivery where legal age cannot be verified.

14. Reviews

Where customer reviews are published, the review interface states whether and how it is verified that the review comes from a person who purchased or used the product. False reviews are not published and reviews are not altered in order to promote products.

15. Liability

No term limits the Consumer’s mandatory rights or excludes liability that cannot legally be excluded. Within the limits permitted by law, the Seller is not liable for damage caused by improper use, failure to follow instructions or causes not attributable to the Seller.

16. Personal data

Personal data is processed in accordance with the Privacy Policy. Non-essential cookies and marketing activities are used only on the basis of valid consent where required.

17. Complaints, governing law and jurisdiction

Complaints and requests may be sent to info@galleriamariana.com. These terms are governed by Italian law, without prejudice to the mandatory protection granted to the Consumer by the law of their country of residence. Disputes with a Consumer fall under the jurisdiction of the courts at the Consumer’s place of residence or domicile, where located in the European Union, without prejudice to the Consumer’s right to bring proceedings before another competent court. The Consumer may also seek information on alternative dispute resolution (ADR) bodies recognised by the competent authorities.
